Defence solicitors acting for Shepparton councillor Milvan Muto have applied to the Victorian Civil and Administrative Tribunal to have his gross misconduct case adjorned until after current criminal charges are finalised.
A ruling is expected to be made this afternoon.
The City of Greater Shepparton councillor is in VCAT today facing a gross misconduct charge instigated by the secretary of the Department of Planning and Community Development, which has responsibility for local government. He also faces several criminal charges including blackmail.
Cr Muto has been forced to take a mandatory leave of absence until the criminal charges are determined.
If found guilty of gross misconduct Cr Muto would face disqualification as a councillor and a ban on standing at future elections.
